COVID-19 Disability: Social Security Disability Claims for Long COVID
Understanding SSD for Long COVID
Navigating Life with Long COVID Symptoms
Although much remains unknown about the long-term effects of COVID-19, it’s clear that a significant number of individuals continue to suffer symptoms long after their initial recovery. Known as "Long Haulers," these individuals may experience debilitating issues that impact their ability to work and maintain daily activities.
According to the Centers for Disease Control and Prevention (CDC), Long COVID symptoms can include:
Fatigue or tiredness
Difficulty concentrating or memory issues ("brain fog")
Headaches
Loss of smell or taste
Dizziness when standing
Heart palpitations
Chest pain
Shortness of breath or difficulty breathing
Chronic cough
Muscle or joint pain
Anxiety or depression
Fever
Symptoms that worsen with physical or mental exertion
SSD Eligibility for Long COVID
These symptoms can be profoundly disabling, preventing individuals from returning to work even after recovering from the virus. While the Social Security Administration (SSA) has yet to establish specific criteria for Long COVID, individuals may still qualify for disability benefits if they can demonstrate that their condition meets or equals the severity of other recognized impairments such as Chronic Fatigue Syndrome, COPD, or cognitive dysfunction similar to traumatic brain injury.
At Binder & Binder®, we assess COVID-related claims just like any other. The process starts with obtaining medical documentation to support that you have a medically determinable impairment. Your treating physician must also support the position that your symptoms will prevent you from working for at least 12 months.
We use detailed medical records and physician statements to build a strong case that shows how your symptoms have impaired your ability to maintain gainful employment. In cases involving extended hospital stays or ventilator use, we also demonstrate the need for long-term rehabilitation and recovery.
